Whish Pay
What is Whish Pay?
Whish Pay is a payment service provided by WHISH MONEY SAL (“Whish”) that makes it easier to complete your transactions with other users of the Website.
You, as a seller and user of the Website, can enable delivery and Whish Pay services on your eligible ads and link your Whish account, allowing other users, acting as buyers to purchase the item you advertised for, and pay through Whish, directly from the Website.
The payment service is provided exclusively by Whish under its own license and terms.
The item is delivered by PiknDrop, an independent third-party delivery service provider, while the payment is held by Whish until the order is completed, i.e. until PiknDrop confirms that the item has been delivered.
Once the order is completed, Whish transfers the amount due to the seller's linked Whish account.
How does Whish Pay work?
For sellers
Sellers can enable Delivery and Whish Pay on eligible ads and link their Whish account.
When a buyer purchases the item advertised by the Seller:
- The buyer pays the price of the item, the OLX transaction fee and the delivery fee through Whish.
- PiknDrop handles the delivery from the seller to the buyer.
- Whish holds the payment until the order is completed as confirmed by PiknDrop.
- Once the order is completed, Whish transfers the amount due, less the OLX transaction fee and the delivery fee, to the seller's linked Whish account.
- If PiknDrop's delivery confirmation is not received within fifteen (15) calendar days from payment, Whish refunds the buyer automatically, even if the item has been delivered. In that case, any claim to recover the price lies against the buyer, Whish or PiknDrop, and not against OLX.
For buyers
Buyers can purchase eligible items through Whish Pay without having to arrange a cash payment with the seller.
- Select an item where Whish Pay and Delivery are available.
- Pay the price of the item, the OLX transaction fee and the delivery fee through Whish.
- The item is delivered by PiknDrop.
- Once the order is completed, Whish transfers the amount due to the seller.
When does the seller receive the payment?
The payment is not transferred to the seller immediately.
It is held by Whish until PiknDrop confirms that the order has been delivered, for a maximum of fifteen (15) calendar days from payment.
Once the order is completed, Whish transfers the amount due, less the OLX transaction fee, to the seller's linked Whish account.
The item is usually delivered within 2 to 4 business days.
What are the OLX fees?
OLX charges the buyer a transaction fee for making the Website available and facilitating the transaction for Whish, and the users. All applicable fees and charges are displayed before the order is confirmed.
OLX is not a party to the sale between the buyer and the seller, nor to the delivery. OLX merely hosts the transactions on its Website and is not a financial, payment or money transfer service provider. The payment service is provided exclusively by Whish under its license.
What happens if the order is cancelled?
The buyer or the seller may cancel the order through the Website at any time before PiknDrop confirms delivery. If the order is cancelled before it is completed, or if delivery is not confirmed within fifteen (15) calendar days from payment, Whish refunds the buyer's payment in accordance with its own terms and refund procedures. If PiknDrop has already collected the item or attempted delivery at the time of cancellation, the delivery fee is not refunded.
Terms of Use – Whish Pay
By using www.olx.com.lb or the corresponding mobile application (collectively, the “Website”) to buy or sell items through Whish Pay, you confirm that you have read, understood and accept these terms, which govern your use of Whish Pay, the Delivery, in addition to the Website terms of use and privacy policy, and you agree to comply with them. If you do not accept or agree to comply with these terms, you must not use Whish Pay.
These terms are made between Epicamo Lebanon SARL (“OLX”, “we”, “us”, “our”) and you (“you” or the “User”).
1. You agree and acknowledge that the Website may contain ads placed by other users, advertisers or companies for the sale of goods or services, for which OLX takes no responsibility.
2. You agree, understand and acknowledge that the Website is an online classifieds platform that enables users to offer goods and services for sale and to purchase them from other users and, for eligible ads, to pay through Whish Pay.
3. You agree, understand and acknowledge that OLX and you are independent parties and, notwithstanding anything contained herein, nothing shall be construed or deemed to create any association, partnership, joint venture, agency, franchise, sales representative, or employment relationship between us.
4. Payments through Whish Pay are processed exclusively by Whish, which collects, holds, transfers and refunds the payment under its license and its own terms. Any payment agreement with respect to such payments shall be exclusively between you and Whish. OLX does not itself collect, hold or transfer the price paid for the item (any delivery fee received by OLX being passed on in full to PiknDrop), and is not responsible or liable for the services provided by Whish, including any failure, delay or error in any payment, transfer or refund. Whish holds the payment until PiknDrop confirms that the item has been delivered, for a maximum of fifteen (15) calendar days from payment. The buyer or the seller may cancel the order through the Website at any time before such confirmation. If the order is cancelled, or if delivery is not confirmed within that period, Whish refunds the buyer (less the delivery fee, where PiknDrop has already collected the item or attempted delivery at the time of cancellation) in accordance with its own terms, even if the item has been delivered, in which case any claim of the seller to recover the price lies solely against the buyer, Whish or PiknDrop, and not against OLX.
5. Before using Whish Pay, you must read, and by using it you acknowledge and accept, the terms and conditions of Whish, which govern the payment service, and the terms and conditions of PiknDrop, which govern the delivery service. [Links to be inserted.]
6. An item listed on the Website constitutes an offer for sale by the seller, not by OLX. When a buyer purchases an item through Whish Pay, the sale is concluded exclusively between the buyer and the seller, and OLX is a third party to the sale. OLX does not own, inspect, sell or deliver the items and is not liable for the items, including their quality, safety, legality, condition, conformity with their description or delivery, nor for the performance of the sale by the seller or the buyer. The offer of items on the Website does not, in any manner, imply that OLX endorses or is affiliated with the items or the sellers.
7. Delivery is performed by PiknDrop, an independent third-party delivery service provider. OLX is not a party to the delivery and is not responsible or liable for it, including for any delay in delivery or any loss of or damage to the items, all of which are governed exclusively by the terms and conditions of PiknDrop.
8. OLX charges the buyer a transaction fee, independently determined by OLX and displayed on the Website, as compensation for making the Website available and facilitating the transaction between the buyer and the seller. The transaction fee is deducted from the amount transferred to the seller. Any other fees and charges, including the delivery fee and any Whish fees, are displayed before the order is confirmed.
9. The seller is solely responsible for its ads and items, including the accuracy of their description and price, their lawfulness, their compliance with applicable laws and with the Website terms and conditions, and for making the items available to PiknDrop for delivery.
10. Any dispute relating to a sale, payment, refund or delivery shall be resolved directly between the users concerned, Whish and/or PiknDrop, as applicable. OLX may, at its sole discretion and without any obligation or liability, assist in the resolution of such dispute.
11. Whish Pay is made available on an “as is” and “as available” basis. OLX does not guarantee that it will be uninterrupted or error-free, or that any sale will be completed. OLX may, at any time and without liability, suspend, restrict or discontinue Whish Pay, in whole or in part, remove any ad, or suspend any User’s access to it, notably in case of breach of these Terms or suspected fraud, and may amend these Terms by publishing the amended Terms on the Website with reasonable prior notice, such amendments applying only to orders placed after their publication.
12. You acknowledge and agree that OLX shares with Whish and PiknDrop the personal data required for the performance of the payment and delivery services, in accordance with the privacy policy published on the Website. Whish and PiknDrop process such data under their own responsibility and privacy policies.
13. To the maximum extent permitted by law, and save in the case of fraud or gross negligence of OLX, OLX shall not be liable for any:
(a) consequential, indirect or special losses, or exemplary damages (even if OLX has been advised of the possibility of such losses or damages);
(c) loss of business;
(d) loss of revenue;
(e) loss of or corruption to data;
(f) loss of use;
(g) loss of production;
(h) loss of contract;
(i) loss of opportunity;
(j) loss of savings, discount or rebate (whether actual or anticipated);
(k) harm to reputation or loss of goodwill,
whether direct or indirect, howsoever arising, suffered by any User in connection with these Terms, Whish Pay or any sale, payment or delivery, or for any act or omission of Whish, PiknDrop, the seller or the buyer, or for any liability of a User to any third party.
14. To the maximum extent permitted by law, the total liability of OLX to any User in connection with any sale made through Whish Pay shall not exceed the amount of the transaction fee received by OLX for that sale.
15. You shall indemnify and hold OLX harmless from and against any claim, loss, damage, cost or expense, including reasonable legal fees, arising from your breach of these Terms or of applicable law and, where you are a seller, from your ads or items.
16. You acknowledge and undertake that you are accessing the Website and transacting at your own risk and are using your best and prudent judgment before entering into any transactions through the Website.
17. All other terms and conditions and the privacy policy published on the Website continue to apply to your use of the Website and of Whish Pay, and form an integral part of these Terms. In the event of any inconsistency between them and these Terms in respect of Whish Pay, these Terms shall prevail.
